Final Order / Judgement

This order shall dispose of present complaint after affording preliminary hearing to the counsel for the complainant.

The learned counsel for the complainant has argued that complainant is the owner of one DIAI Battery Operated Bike-Chetan/Scooter bearing Plate No. CH-W-861 and the said scooter was comprehensively insured with the opposite parties vide policy of insurance placed on file, with IDV of Rs. 56,000/-. It is further argued that said scooter of the complainant was stolen on 11-1-2023 from Gole Diggi, Gole Market, Bathinda. Complainant had lodged complaint with SSP, Bathinda on 12-1-2023 and thereafter police registered FIR No. 25 of 11-2-2023 under Section 379 of IPC at P S Kotwali. It is further argued that complainant had given intimation to the opposite parties regarding theft of scooter but inspite of receiving intimation, opposite parties have not settled the claim of the complainant, which amounts to deficiency in service.

We have heard learned counsel for the complainant and gone through the entire record and case file.

A perusal of entire file and record shows that complainant has not placed on file any intimation letter or e-mail or text message to prove that opposite parties were ever intimated by complainant regarding theft of his vehicle. As such, without going into merits of the case, present complaint is hereby disposed of with following directions :

Complainant is directed to give intimation to the opposite parties regarding theft of his vehicle within one week from the date of receipt of copy of this order and opposite parties are directed to settle the claim within 45 days thereafter, after receipt of intimation.

No order as to costs.

Copy of order be issued to complainant free of cost and file be consigned to record room.
