By way of this order we are disposing off the application filed by OP for depositing the awarded amount passed by this Commission vide order dated 12.06.2014. It is stated in the application that the order dated 12.06.2014 was upheld by Ld. State Commission by dismissing the appeal filed by OP vide order dated 24.03.2023.

            Hence, the OP requested for taking on record the DD bearing no.059104 dated 12.07.2023 in the name of complainant Ms. Kanika Rai for a sum of Rs. 10,80,148/-.

            During the pendency of the aforesaid application,  the OP Ins. Co. moved another application for releasing /withdrawal of the DD deposited by it.

            We have heard the arguments on both the applications. Since the OP moved an application for withdrawal of the DD in question, the application for depositing of the DD stands dismissed in limine.

            In respect to the withdrawal of the DD deposited by OP, we are of the considered view that since no execution petition is pending before this Commission against order dated 12.06.2014 we permit OP to collect the original DD from the record and send the fresh DD directly to the complainant after searching her address.

            With the above observation the application for withdrawal of the DD stands disposed off.
