Today when the matter is called out at 02:25 p.m., the Complainant so also Learned Advocate for the Complainant is absent.  On perusal of the order-sheet it is evident that the Complainant was absent even on 1/8/2011, 27/9/2011 and 5/12/2011.  The Complainant has not filed affidavit evidence in terms of Section-13(4) of the Consumer Protection Act, 1986.  Adv. A. S. Vidyarthi for the Opponents Nos.1, 2, 3 & 5 has already filed affidavit evidence and also filed a pursis closing his side of evidence.  Today the matter is fixed for filing written notes of arguments in terms of Regulation No.13(3) of the Consumer Protection Regulations, 2005.  The Complainant has not filed his briefs of written arguments.  Hence, the complaint stands dismissed for default.  No order as to costs.  Inform the parties accordingly.
