          The appellants are the complainants in CC.356/2010 in the file of CDRF, Thrissur.  Complaint stands dismissed on the ground that the same is not maintainable as the equipments has been purchased for commercial purposes.

          2. The matter is with respect to the insurance claim of the equipments insured which broke down.  It is settled law that the insurance claims can not be held as not maintainable as the policy is availed not for commercial purpose but to compensate for the loss sustained.

          3. In the result the order of the Forum is set aside.  The Forum is directed to dispose of the case on merits.  The Forum will issue notice to the opposite parties. 

          4. The matter stands posted before the Forum on 20.1.2012.

          Office will forward the copy of this order to the Forum urgently.
