Today is fixed for admission hearing of the complaint.
No step taken by the complainant. None appears on behalf of the complainant at the time of its call.
It appears from the record that this Consumer Complaint was filed on 01.08.2018 u/S. 12 of the C. P. Act, 1986. Thereafter date was fixed on 07.08.2018 for admission hearing. On that date complainant has not taken any step. Date was fixed on 08.08.2018 for admission hearing. On that date no step was taken by the complainant. So the date was fixed on 21.08.2018 for admission hearing of the complaint.
As the case was filed on 01.08.2018, therefore, the admission hearing of the complaint must be completed within 21 days from the date of filing of the complaint as per sub-section 3 of Section 12 of the C.P. Act, 1986, which runs as:
(3) “On receipt of a …………………………………………………. complainant:
Provided further that the admissibility of the complaint shall ordinarily be decided within twenty-one days from the date on which the complaint was received”.
Therefore, this Forum cannot proceed with the case further as the complainant is absent after filing of this complaint and after admission, twenty-one days time limit for hearing on the point of its admissibility is also elapsed. So, we have no other option but the dismiss the complaint.
Hence, it is

that the Consumer Complaint being no. 121/2018 be and the same is dismissed for non-prosecution without any cost.
Let plain copy of this order be supplied to the complainant free of cost as per provisions of law.
