Order No.18, Dated: 09.03.2015

            Dhr. files hazira.  The Jdr. files a petition praying to dispose of the case on full and final satisfaction along with a banker’s cheque for Rs.3,46,453/- being No.073433 dated 16.2.2015 drawn on HDFC Bank.  The cheque as mentioned be kept in safe custody of this Forum for handing over the same to the Dhr.

            The petition filed by the Jdr. is taken up for hearing.  Heard both the sides. Ld. Advocate for the Dhr. has submitted that the amount as mentioned in the banker’s cheque will satisfy the impugned final order passed in D.F. Case No.01/2012. 

We carefully perused the impugned final order and the banker’s cheque filed this day and we hold that the amount has mentioned in the banker’s cheque will satisfy the impugned final order.  So, there is no bar to dispose of this execution case on full satisfaction.  Hence it is

ORDERED

 that the Execution Application No.25/2013 is disposed of on full satisfaction with liberty to the Dhr. to receive the banker’s cheque as mentioned in the body of this order on filing the necessary papers  showing his identification and on proper receipt.  Let the copy of this order be supplied all the parties free of cost.
