Per Mr S M Shembole, Hon’ble Presiding Member

          None for the appellant is present. Its counsel Mr Bele is also absent. Adv. Mr B Lahiri for the respondent is also absent. However, his Proxy Adv. Mr Dhiman Chatterjee appeared and filed authority letter issued by Adv. Mr Lahiri. 


          Appellant as well as its counsel are absent since 21.07.2010. Therefore, on last date in stead of dismissing the appeal in default it was adjourned till today by way of last chance. But today also the appellant as well as its counsel are absent.

              Therefore, we have no alternative except to dismiss the appeal in default and accordingly, the appeal is dismissed in default.


         No order as to cost.
