Appeal No.187 of 2015

14.05.2018               Heard the learned counsel for the appellant and respondent. Appellant files written notes of argument.

          In this case appellant submits that even though the claim was lodged the complainant was directed to submit proper claim before the respondent insurance company. On the other hand respondent submits that as stated in the written statement the claim form containing the relevant details and the copy of the documents were not submitted. Without going into the aforesaid controversy the direction of the District Forum to file all relevant with proper claim form cannot be faulted in absence of cogent material to show that claim form with all relevant documents were lodged in terms of the insurance policy in question. We however permit the appellant (complainant) to file all the relevant documents along with proper claim before the respondent no. 1 within a period of one month along with certified copy of the present order. Respondent shall complete settlement of claim within a period of two months thereafter. The impugned order is modified as above.

In the result, the appeal stands disposed of.
