Case taken up today as the President and Member have been given additional charge of District Consumer Commission, Gurdaspur for every Thursday and Friday. Today, the counsel for the complainant has made a statement recorded separately that as per the application of the opposite party dated 17.03.2020, the opposite party has denied the lodging of any claim by the complainant with the Insurance Company.  As such, the complainant will lodge afresh claim with the Insurance Company qua the present subject matter and the present complaint may be disposed of with the direction to the  Insurance Company to decide the claim within the stipulated period.

Thus, we are of the considered opinion  that the present complaint  can be disposed of by giving direction to the complainant  to file the claim within 15 days and by directing the opposite party to decide the claim within next one month. Hence, we direct the complainant to file the claim  with the Insurance Company-opposite party within a period of 15 days  from today  and opposite party shall decide the claim of the complainant within 30 days  from the date of filing of the claim by the complainant. The entire exercise shall be completed within a period of 45  days from today  in all. The complaint stands disposed of accordingly. File be consigned to record.
