M/s Surindra Music House Vs. UIIC

CC No. 101 of 2017.

 

Present: Sh. Yajvinder Singh, Advocate, counsel for complainant.

 

                        Heard on the point of admission. After going through the contents of the complaint, it is duly clear that the alleged occurrence took place on 02.11.2010 but the present complaint has been filed on 03.03.2017 i.e. after a period of near about 6 years 4 months. Furthermore, neither any application for condonation of delay has been filed nor any reason has been explained in the complaint itself. From the perusal of Para No.6 of the complaint it has come to the notice that previous complaint filed by the complainant has been dismissed considering all the facts of the case but neither the copy of that order has been placed on file nor any date of order or date of institution has been placed on file due to the reasons best known to the complainant. It has nowhere been mentioned in the complaint that any time spent in the previous complaint was granted or any liberty to file the fresh complaint was granted to the complainant. Hence, the present complaint is hopelessly time barred as per section 24(A) of the Consumer Protection Act and is also not maintainable and the same is hereby dismissed in limini. The Assistant is directed to return the original documents, if any, to the complainant after retaining the photo copies of the same on the file. Copy of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
