4)       th     According to the Complainant, the surveyor who was appointed by the Opposite Party was of obnoxious attitude.                   

5)       written statement.     The copy of which is marked as Exh.‘III’.     .30 undersize which clearly confirms that someone had intentionally removed the original engine and replaced it with another.

7)             Furthermore, it is pertinent to note thereafter the Complainant did not contact the office of the Opposite Party and disclosed the situation in what condition the car was found and also did not request to appoint surveyor as regards the valuation of preliminary damages of the car which was found in the custody of Tawarekere Police Station.          Thus, it appears that the claim made by the Complainant to compensate the charges of repairs as shown in the documents issued by Car Lunge Pvt. Ltd. cannot be granted in favour of the Complainant.   

O R D E R

i.                   Complaint No.401/2006 is dismissed with no order as to cost.

ii.                Certified copies of this order be furnished to the parties.
