A jeep-Bolero bearing registration No.HR-05Y-9121, owned by Anshul Bansal-complainant/appellant, was insured with United India Insurance Company Limited (for short ‘the Insurance Company’)-Opposite Parties/respondents. The Insured Declared Value (IDV) of the vehicle was Rs.4.00 lacs.
2. On March 16th, 2013 the jeep was stolen. F.I.R. No.214 was lodged in Police Station, Civil Lines, Karnal on the same day. The Insurance Company was informed. The complainant filed claim with the Insurance Company but it did not pay the insured amount. Hence, complaint under Section 12 of the Consumer Protection Act, 1986 was filed before the District Consumer Disputes Redressal Forum, Karnal (for short ‘the District Forum’).

The District Forum, vide its order dated June 16th, 2016 allowed the complaint and directed the Insurance Company to pay Rs.4.00 lacs, that is, IDV of the vehicle, alongwith interest at the rate of 9% per annum from the date of filing of the complaint, that is, July 27th, 2015 till its realization and Rs.5,500/- for mental agony, harassment and litigation expenses.
4. By filing this appeal the prayer made is to enhance the compensation.
5. Indisputably, the jeep was insured for Rs.4.00 lacs and that amount has been awarded to the complainant alongwith interest @ 9% per annum from the date of filing complaint till its realisation. Besides, the complainant has been awarded compensation of Rs.5500/- for harassment and litigation expenses.
6. This Commission feels that the complainant has been sufficiently compensated and there is no scope for enhancement of compensation. Hence, the appeal is dismissed.
