The complainant aggrieved by the delay in processing the claim form of the complainant by the third O.P. has come up with this complaint seeking a direction to the opposite parties to pay Rs.1,00,000/- as damages besides damages for mental agony etc., As could be found from the letter of the fourth O.P. dated 17.10.2008 in which opposite party has stated that they need sometime to process the claim of the complainant and they have even requested the complainant to give minimum 15 days for appropriate action. It appears that the complainant has not met opposite party information in he having had met the fourth O.P. for expediting the claim. However, the counsel for the complainant submits the complainant had orally requested as evident from the complaint placed before us the opposite parties has not repudiated the claim of the complainant. The complainant without waiting for some reasonable time has rushed this complaint without any cause of action. Hence the complaint is dismissed with a liberty to the complainant to approach this Forum in the event of the opposite parties repudiating his claim.
