The appeal is filed by the complainants in OP.1020/04 who are the LRs of the deceased assured who was covered under the Janatha Personal Accident Policy.  He died in a traffic accident.  The Forum has held that  only the Motor Accidents Claims has Tribunal jurisdiction in the matter.  Forum has relied on a decision of the National commission also  which apparently  is not relevant in the context.  The complaint herein is  maintainable  with respect to the insurance claim.  The order of the Forum is totally incorrect and the same is set aside.

2. It is noticed that the opposite parties/Insurance Co. has been set ex parte.  In the circumstances the matter is remitted back to the Forum.  The Forum is directed to issue notice to the opposite parties.  Forum will consider the matter afresh and dispose of the same.

3. The case stands posted before the Forum on 8.6.2010.

Office will forward the copy of this order to the Forum urgently.
