Today is fixed for appearance of complainant & admission hearing.

The petition of complaint was filed on 05.09.2024 through e- filing/E-DAKHIL & complainant was informed through e-mail to appear before the Commission on 19.09.2024 but complainant did not appear & once again opportunity was given to him directing to appear with documents this day, also informed through e-mail but the complainant did not appear either in person or through any representative.

It is apparent that statutory period of 21 days for admission of complaint has been completed this day U/s 36 (2) of C.P.Act,2019.

Petition of complaint shows that it is an appeal U/s 41 of the C.P.Act, 2019 for setting aside the judgment dated 20.09.2022 passed by this Commission in C.C.No-63/2022.

Section 41 runs as

Any person aggrieved by an order made by the District Commission may prefer an appeal against such order to the State Commission on the grounds of facts or law within a period of forty-five days from the date of the order, in such form and manner, as may be prescribed.

We thus are of the view that this Commission has no power to hear this appeal preferred against order of this Commission as stated in petition of complaint.

Hence, it is

O r d e r e d

that the petition of complaint/appeal registered as case No:C.C-53/2024  be and the same is rejected.
