“We referred to your representation pertaining to the captioned claim lodged by you. 

We have discussed the matter in detail with Surveyor M/s. Parimal R. Shah & Co. The Surveyor has now submitted his comprehensive observation/assessment vide letter dtd.23/10/2010 detailing the status in the matter and reporting that the estimated loss working is NIL. 

We enclose a copy of Surveyor’s letter, referred to above, for your perusal and reference.

In view of the observation/assessment of the Surveyor as above, there being NIL liability for the alleged loss, we are closing the claim which please note.”

O R D E R

i.                 Complaint No.303/2011 is dismissed with not order as to cost with the observation that the dismissal of this complaint will not operate to the prejudice of the Complainant/Insured Company – M/s. Maharashtra Esters & Ketones Pvt. Ltd. in the matter of his/its pursuing other remedies.
