ORDER

The complainant has filed the present complaint against the opposite parties PSEB and its functionaries for seeking direction of the Forum for not recovering the amount in question worth Rs.9000/- as per letter No. 2841 dated 8.9.2006 being illegal, null and void besides monetary compensation for physical harassment and mental tension on account of deficiency in service with cost of litigation. The opposite parties appeared and contested the case of the complainant. The parties led evidence upto their satisfaction. After hearing the counsel for the parties and going through the file we accept the complaint partly and the opposite parties. Board is directed to separate the levy of the amount for detection of the aftersaid enhanced load of 2.295 one and half BHP motors for running Toka and one BHP submersible motor for taking water on the basis of CC No. 34/05 Ex.R5 in the impugned notice and quash the portion of the penalty for alleged theft of electricity. However recovery of the penalty amount for detection of the enhanced load and motors may be adjusted from 1/3rd amount already deposited by the complainant vide order dated 10.10.2006 out of total amount of Rs.9000/- and balance amount, if any, may be recovered in accordance with the rules within one month from the receipt of copy of the order. For the purpose of regularization of the meter in question, the complainant is directed to file application to Punjab State Electricity Board Authority for transfer of the connection in his name within one month with a view to equally protect the fiscal interest of the opposite parties of fasten liability upon the consumer to pay electricity charges. Under the circumstances of the case, the parties are, however, left to bear their own costs. File be consigned to the record room. Dated 5.4.2007 Sudha Sharma Sushma Handoo A.K.
