Case has been called several times since morning and ultimately at 3.00 p.m.,but none appeared on behalf of the applicant. Sh.Ashok Kumar Sharma, Asstt.Manager of the respondent No.1 produced copy of the stay order passed by the Hon'ble Commission dated 22.4.2015 vide which Hon'ble State Commission has stayed the operation of the impugned order passed by this Forum subject to deposit of full amount, so awarded by the District Forum after excluding the amount already deposited by the appellant at the time of filing appeal. Respondent also produced copy of the letter dated 14.5.2015 that respondent has also deposited demand draft bearing No.028096 dated 14.5.2015 for Rs.619901/- of HDFC Bank in favour of the Hon'ble State Commission, Chandigarh and copy of that demand draft which proves that respondent has made compliance of the order of the Hon'ble State Commission dated 22.4.2015. As such, order passed by this Forum has been stayed. All this shows that applicant is not interested in prosecuting the present execution application. As such, present execution application is dismissed in default for want of prosecution. However, applicant shall be at liberty to file a fresh execution application after the decision of the appeal filed before the Hon'ble State Commission. File is ordered to be consigned to the record room.
