The record is put up at the instance of the Complainant who by filing a verified petition prays for dismissal of the case on non-prosecution.

Heard both sides.

We find that the complainant has settled the case out of Forum with OP/Bank and unwilling to proceed with case.

We do not find any impediment to allow the prayer.

Hence,

            Ordered,

                        that C.F. Case No. CC/85/2017 be and the same is dismissed for non prosecution. No cost.

Copy of this order be supplied to the parties each free of cost.
