The petition of complaint has been filed by the complainant Sri Biswajit Manna against the o.ps. United Bank of India Gariahat Branch Employees’ Holiday Home & Welfare Society. The case of the complainant in short is that being satisfied with the representation that o.ps. are running holiday home at Rajgir where all the facilities were promised to be all standard quality and complainant booked accommodation for four rooms for nine adults and two children from 24.12.08 to 26.12.08 and reaching there on 24.12.08 complainant got surprised finding deplorable and dilapidated condition  of building and complainant paid booking amount of Rs.3000/-.

            Further case of the complainant is that on return from tour he made reference with o.ps. but o.ps. did not pay heed to his redressal. Hence the case.

            O.ps. had entered their appearance in this case by filing w/v and denied all the material allegations labeled against them and prayed for dismissal of the case. Ld. lawyer of o.ps. in the course of argument has stated that the case has got no merit and the same is liable to be dismissed.

Decision with reasons:

            We have gone through the pleadings of the parties, evidence and documents in particular and we do not find that no effort was taken by complainant to lodge any complaint in the complaint register of the said holiday home and on the contrary, complainant along with others stayed there during the entire booking period and had the standard been not upto the mark. Complainant could not have arranged for alternative arrangement for their staying period. But there is no document on record in these regard in support of the contention of o.p. and complainant lodged on his return with o.,ps. There is nothing on record that complainant lodged complaint on behalf of himself and for others in the form of seeking permission of the ld. Forum at the time of filing the instant case.

            In view of the above findings and on perusal of the entire materials on record we are not satisfied with the contentions of the complainant and we are of the further views that the instant complaint has been filed on the basis of afterthought for the reasons best known to the complainant. Therefore, we hold that the complainant is not entitled to relief.

            Hence, ordered,

            That the petition of complaint is dismissed on contest against the o.ps. without cost.

            Supply certified copy of this order to the parties free of cost.
