O R D E R

 

In short, the case of the Complainant is that the Complainant invested Rs.2 lacs in FDR on 27.07.13 with the maturity date 27.07.16. The OP was supposed to pay Rs.290434/- on the date of maturity. In the month of July, 2016 he submitted original FDR with the OP but the OP did not pay the amount despite passing more than 3 months.  He sent reminder on 28.09.16 but OP has not replied so far. Hence pleading deficiency in service he has filed the present complaint for issuing directions to the OP to pay the principal amount with interest.

 

OP has been proceeded exparte vide order dated 23.03.17.

Complainant has filed his own affidavit in evidence alongwith photocopy of one FDR. There is nothing on the record to show that the OP has paid the amount of the FDR alongwith interest to the complainant.  As per the FDR the OP is liable to pay interest @ 12.5% per annum. Therefore, we hold the OP guilty of deficiency in service and accordingly we allow the complaint. The OP is directed to make the payment of Rs.2,00,000/- (Rs. two lakh) alongwith interest @ 12.5% per annum from the date of maturity till realization.

This order shall be complied within 30 days of receipt of copy of this order failing which OP shall become liable to pay interest @ Rs.15% per annum on the above said amount of Rs.2,00,000/- (Rs. two lakh) from the date of maturity of the FDR till realization.

Let a copy of this order be sent to the parties as per regulation 21 of the Consumer Protection Regulations.  Thereafter file be consigned to record room.
