Admittedly, the complainant herein has approached the Hon'ble High Court of Kerala with the following reliefs : Issue a writ of mandamus and/or other appropriate writ, order or direction directing the first respondent to pay the said amount of Rs. 21,025.90 with interest at the rate of 18% per annum from 1-4-2004 till realisation, within a time stipulated by this Hon'ble Court. Issue a writ of mandamus and/or other appropriate writ, order or direction directing the first respondent to pay the petitioner the maturity value of Ext. P2 Certificate with interest at the rate of 18% per annum from 23-9-2008 till realisation, within a time stipulated by this Hon'ble Court.”
2. The Hon'ble High Court vide order in W.P. (C) No. 1276 of 2010 (H) was pleased to allow the above reliefs vide order dated 17-05-2010. Against which the opposite party preferred appeal before the Division Bench of the Hon'ble High Court. That has been dismissed by the Hon'ble Division Bench of the High Court vide order in W.A. No. 1487 of 2010 dated 22-06-2011.
3. Since the matter involved in this case has been considered and disposed of by the Hon'ble High Court, the consideration of the complaint is beyond the purview of this Forum. In view of that, the proceedings in this complaint stand closed. Pronounced in open Forum on this the 12th day of July 2011. | |
