Today is fixed for hearing of this Consumer Complaint and there was a direction upon the O.P. to hand over the original certificate to the complainant in the meantime.
Heard this case in the background of changing circumstances of amicable settlement between the parties. The conduct of the O.P. goes to show that the O.P. already handed over the original Registration Certificate being No.WB-42-AM-8817 in respect of the vehicle (Motor Cycle) in question and to that effect complainant -Chandan Nandi issued a receipt in the Forum. Therefore, the prayer of the complainant seeking direction for handing over certificate of registration is already complied by the O.P. Now there is a dispute of receiving Rs. 2,620=00 as excess

amount to the said charge of registration which actually from the record goes to show should be only Rs. 5,872=00. However, O.P. submits that he has already stated in his written version in Para 9 that said charge of Rs.2, 620=00 is received as service charge and handling charges for securing this certificate from the authority concerned, which is a system throughout India of accepting the same service charge and handling charge by the Dealers. However there is not specific document to show this Forum that how he realized the excess charge of Rs.2, 620=00 but as the parties has come to a settlement and O.P. is ready and willing to refund the sum Rs. 2,620=00 to the complainant, therefore the Forum has no other alternative but to order the O.P. to refund the said sum Rs. 2,620=00 to the complainant. With this direction, hence, it is

that the present Consumer Complaint is disposed of on compromise without any cost.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
