AWARD

1.   Vide his separate statement recorded on 07.05.2024, Sh.Devinder Kumar, Counsel for OP No.3 has stated that the matter has been settled between the parties and as per settlement, the OP No.3 shall pay an amount of Rs.70,000/- (Rs.67,000/- towards invoice amount and additional Rs.3000/-) to the complainant within a period of 30 days from 07.05.2024 in full and final settlement of the present matter, subject to return of product in question i.e. Samsung Refrigerator, alongwith its accessories if any, by the complainant. Vide his separate statement recorded on 07.05.2024, Sh.Karamjit Singh Chahal, Complainant in person has admitted the aforesaid statement of counsel for OP No.3 and prayed that the complaint be disposed of in terms of aforesaid settlement in National Lok Adalat.

2.   In view of the statements of the counsel for OP No.3 & complainant in person and in terms of the settlement, the complaint stands disposed of by passing the following order:-

1. OP No.3 shall pay an amount of Rs.70,000/- (Rs.67,000/- towards invoice amount and additional Rs.3000/-) to the complainant within a period of 30 days from 07.05.2024.
2. In case OP No.3 fails to pay the aforesaid amount within the stipulated period, then OP No.3 shall be liable to pay the same alongwith interest @ 12% p.a. from the date of filing of present consumer complaint i.e. 18.04.2023 till the payment is made.
3. On receiving the aforesaid payment, the complainant shall return the product in question i.e. Samsung Refrigerator, alongwith its accessories if any, to OP No.3 forthwith.

3.   The award is accordingly passed.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
