            Today is fixed for admission hearing.

            Ld. Advocate for the complainant is present. She files certain documents. Let the documents be kept with the record.

            Heard the Ld. Advocate for the complainant who submits that on 06.11.2018 complainant’s father named Gopal Mahalik was travelling from Howrah Station to Bhadrak by availing Bhubaneswar Jan-Shatapdi Express (Train No. 12073) with valid Reservation Ticket Bearing No. F25124211, PNR No. 672-1629533 dated 06.11.2018 and around 1.25 P.M. the complainant’s father was feeling serious health problem. She further submits that the complainant pulled the chain of the train compartment and train stopped at Santragachi Station. Immediately, complainant requested the railway staff to arrange medical facilities to his father but no railway staff came forward to help the complainant for which the complainant’s father died on Platform No. 03 of Santragachi Railway Station and unnatural death case being U.D. Case No. 70/2018 dated 06.11.2018 was initiated. According to the Ld. Advocate for the complainant there is deficiency in service on the part of the Railway Authority for which the complainant’s father died at railway platform.

            Having heard the Ld. Advocate for the complainant coupled with documents on record particularly Post-Mortem Report it appears to us that the cause of death   of Gopal Mahalik was due to disease of Brain and Lungs-a natural cause. In view of the opinion of Medical Officer (Medico Legal) of Howrah District Hospital we are of the view that there is no deficiency in service on the part of South-Eastern Railway Authority. The father of the complainant died in a natural cause. As such, the complaint is not admitted.

 Hence,

                                                          ORDERED

That the complaint case is not admitted and dismissed in limini.

Liberty be given to the complainant to ventilate his grievance to the competent Forum, if so desire.
