          This appeal was listed before the Bench on 6.2.2009 on which date counsel for the appellant brought to the Notice of the Bench that the appellant had died on 14.4.2007. That in spite of the letters issued by him to the appellant and reminders sent repeatedly at the available address, no one has contacted him. The counsel stated that he is not in a position to proceed with the matter and sought discharge. The counsel for the appellant was discharged in the aforesaid circumstances and the case was adjourned sine die with liberty to the LRs of the deceased to get the appeal revived, if so advised. Counsel for the appellant was directed to file the proof of sending the letters to the respondent within a week, which was done. The case was listed before the Registrar on 13.2.2009 for completion of service. Registry was directed to send a letter on the address of the appellant for bringing the LRs on record. Letter sent by the Registry to the appellant has been received back unserved with postal remarks “left”.
          The last letter sent by the counsel for the appellant to the appellant is dated 14.3.2009 informing the appellant about the order passed by this Commission on 6.2.2009. No application has been filed by the LRs to come on record.

          Dismissed having abated and for non-prosecution.
