Both sides are present through their respective Ld. Advocates. 

This is an application U/S 17A of the Consumer Protection Act, 1986 for transfer of the complaint case being Case No. DF 43/2010, from the District Forum of Cooch Behar to any other appropriate Forum on the ground that the husband of the complainant is the presiding officer of the aforesaid Cooch Behar District Forum.  This fact has not been disputed by the OPs.  For the interest of justice and in view of the principles repeatedly laid down that the adjudicating authority should not only be impartial in deciding a case but it must seem to be impartial in the public eye, we transfer the aforesaid complaint case to the nearest District Forum at Jalpaiguri for decision on merits.  The Transfer Application being TA/4/2010 is thus allowed.
