This case is also filed for passing order in respect of M.A. being No.42/2021. On 05.10.2021, the complainant filed the M.A. case being No.42/2021 praying for passing an interim order directing the respondents, particularly the Respondent No.4 and the Respondent No.7 because for renewal of applicant’s  driving license (D/L No.WB-3719760043342) without the imposition and collection of the preposterous fine /penalty of Rs.4000/-only and any other fine /penalty for delay due to litigation on the ground that the complainant not disqualified otherwise is suffering from his basic right of holding a driving license for which he cannot drive is own vehicle and has been sustaining unnecessary expenses for his own and his dependent family members’ convenience charges for the last one and half years although he is  bearing expenses towards road tax, insurance, renewal of vehicle registration and pollution certificate. This petition is also supported by an affidavit.

Perused the M.A. case being No.42/2021 and the complaint of the complainant. It appears that the complainant has prayed so many reliefs mentioned in Para 19 of the complaint in which one prayer is to renew his existing driving license forthwith and while he wanted the cancel his previous application dated 24.05.2020  and retried to surrender the lapsed license by paying the free of Rs.200/- and further proceeded to renew the required NT License by paying Rs.300/- renewal fee against freshly generated application and did show by providing new application dated 19.07.2020 but all in vain and he was misinformed that he need not pay the fine but this time also the system took him to the e-payment site to pay the fine of Rs.4000/- for reviving/ renewing the lapsed transport license and Rs.200/- to the surrender fee of his revived license which can be decided only by the evidence on the side of the complainant.

In view of the abovementioned Order No.20 dated 05.08.2022, the case is in the stage of ex parte hearing and while the case is in the stage of ex parte hearing, the M.A. case should be disposed of at the time of the conclusion of the ex parte order in this case.

 Hence, it is 

ORDERED

that this M.A. case being No.42/2021 be and the same is disposed of in view of the above findings.

Let the case be fixed for ex parte hearing.
