Today is fixed for appearance of the parties.

The complainant is present in person.

Ld. Advocate appearing for the complainant namely Dilip Kumar Saila files an application seeking appropriate order on the ground that the complainant is not interested to proceed with the case.

It is submitted by the Ld. Advocate of the complainant that the matter has been patched up amicably out of Court in the Meanwhile, for which the complainant prays for necessary order ensuring disposal of the case. It is complainant who has set law in motion giving rise to the registration of the case and it is prerogative he can back out on any stage.

Therefore the petition filed by the complainant calls for action.

Hence, it is ordered that :-

    the case be and the same is dismissed as withdrawn.

Let a plain copy be given to the parties free of cost as per CPR.
