The case is called out.
Learned counsels for the respective parties are present.
Heard Sri Paras Nath Tiwari, counsel for the appellant and on behalf of Union Bank of India Sri R.P. Verma, Advocate holding the brief of Aasif Razzaque Khan, counsel for the respondent.
The instant appeal has been filed against the impugned order dated 19-05-2022, which is being reproduced herein below :-
“पेश। 6 ग विलम्ब माफ करने हेतु प्रार्थना पत्र प्रस्तुत किया गया है। भुगतान 20-6 में लेना था और परिवाद 2022 में दाखिल किया जा रहा है। सुना तथा पत्रावली का अवलोकन किया। इस संदर्भ में हम न्याय निर्णय R.B. Ram Lingham Vs R.B.Bhuvneshwari C.L.T. 188 (S.C.) 2009 (2) का अवलोक किया जाय तो क्रस न्याय निर्णय में यह अभिघटित किया गया है कि विलम्ब को स्वीकार करने योग्य

विवरण देना चाहिए। याची ने विलम्ब का जो स्पष्टीकरण दिया है वह सन्तोषजनक नहीं है। अत: प्रार्थना पत्र खारिज किया जाता है।
पत्रावली दाखिल दफ्तर हो।”
By the impugned order, the Learned District Consumer Commission has rejected the application filed as Application No. 6 C.
From a perusal of the record and after hearing the learned counsel for the appellant Sri Paras Nath Tiwari, this fact is not disputed that the claim in the complaint related to certain alleged discrepancy by the opposite party bank, if the contents of the complaint are correct, the same should have been brought to the notice of the opposite party bank concerned within a reasonable time, however, in the instant case, the Learned District Consumer Commission has noticed that the allegation with respect to missing of the demand draft allegedly issued to the complainant in the year 2006 whereas the complaint/application has been filed after a gap of more than 14 years.
In my opinion, the impugned order passed by the Learned District Consumer Commission is just and proper and needs no interference.
Accordingly, the appeal is dismissed.
However, it is open to the complainant/appellant to approach the concerned bank/Authority for the relief mentioned in the complaint.
Let copy of this order be made available to the parties as per rules.
