ORDER

 Mr.Vipin Gogia, Advocate has put in appearance on behalf of the respondent.

In terms of our order dated 18.1.2012, learned counsel for the petitioner has handed over two drafts in the sum of Rs.50,000/- and Rs.7,000/- towards costs and litigation expenses respectively to the counsel for the respondent.

With the consent of the counsel for the parties, revision petition is disposed of at the preliminary stage.

State Commission dismissed the appeal for non-prosecution as the counsel for the petitioner did not appear thrice on the dates fixed.  Limited notice was issued to the respondent to show cause as to why the impugned order be not set aside and the case remitted back to the State Commission for a fresh decision in accordance with law subject to payment of Rs.50,000/- as costs.  Cost of Rs.50,000/- and litigation expenses of Rs.7,000/- have been paid today in court.  Counsel for the respondent has no objection to the setting aside of the impugned order and remittance of the case to the State Commission for a fresh decision. 

In view of the concession made by the counsel for the respondent, impugned order is set aside and the appeal restored to its original number.

Parties, through their respective counsel, are directed to appear before the State Commission on 6.8.2012.
