Challenge in these proceedings is to the order dated 28.03.2011 passed by Haryana State Consumer Disputes Redressal

Commission, Panchkula (in short, the State Commission’) in appeal No. 243 of 2004.  The appeal was filed against an order dated 16.12.2003 passed by the concerned District Consumer Forum, thereby allowing the complaint and directing the opposite party-UHBN Limited not to recover the penalty of Rs.60,000/- from the complainant with certain stipulations.  In appeal, the State Commission has thoroughly examined the controversy and has set aside the order of the District Consumer Forum by giving cogent reasons.  In our view, the findings and conclusion reached by the State Commission are based on correct and proper appreciation of the evidence and material brought on record and suffers from no illegality, material irregularity or any jurisdictional error, which warrants interference of this Commission in revisional jurisdiction under Section 21(b) of the Consumer Protection Act, 1986.

The revision petition is dismissed accordingly.
