Petitioner had accepted his liability during the checking by vigilance when petitioner was found stealing the electricity.  Respondent imposed a penalty of Rs.60,900/- which was accepted by the petitioner without prejudice and paid the amount.  After paying so, petitioner filed a complaint before the District Forum.  District Forum allowed the complaint but the State Commission has reversed the order of District Forum by saying that since the petitioner has paid the amount without prejudice, he cannot seek the refund of the amount.  Dismissed.
