O R D E R

The instant appeal has been filed by Satish Kaur–complainant against the order dated September 20^th, 2016 passed by District Consumer Disputes Redressal Forum, Ambala (for short ‘District Forum’) whereby the complaint was dismissed in default.

2.      Notice issued to respondents. Shri B.D. Bhatia, Advocate accepts notice on behalf of the respondents.

3.      Mr. Satinder Singh Soni has urged that on the date fixed, that is September 20^th, 2016 he enquired from the office of District Forum about his case and he was informed that the President of the District Forum would join on the same day and effective hearing shall not be taken in the case. On getting this information, he did not go to the District Forum and the complaint was dismissed in default.

4.      Be that as it may, without delving deeper, this Commission deems it appropriate to restore the complaint.  The appeal is accepted and the impugned order is set-aside. The complaint is restored to the board of District Forum for adjudication.

5.       The parties are directed to appear before the District Forum on November 04^th, 2016.

6.      Copy of this order be sent to the District Forum.
