2.      Anand SO Accounts and his account Staff, UHBVN Limited, Sector-12, Karnal, who maintain the records of accounts of consumers of electricity of Karnal.

O R D E R

The instant appeal has been received by post. It has been filed by Kulbhushan Rai Chuchra–complainant (appellant herein), challenging the order dated September 07th, 2017 of District Consumer Disputes Redressal Forum, Karnal (for short ‘District Forum’) whereby, complaint was dismissed in default.

2.      Notice be issued to the respondents. Shri B.D. Bhatia, Advocate accepts notice on behalf of the respondents.

3.      It has been stated by the complainant that on September 07th, 2017 when the complaint was dismissed in default, he was present in person and the next date given to him was November 09th, 2017 but lateron he learnt that on September 07th, 2017, the complaint was dismissed in default.

4.      Be that as it may, without delving deeper, this Commission deems it appropriate to restore the complaint.  The appeal is accepted and the impugned order is set-aside. The complaint is restored to the board of District Forum for adjudication.

5.      The District Forum is directed to issue notice to the complainant and shall proceed in accordance with law.

6.      The opposite parties-respondents are directed to appear before the District Forum on February 28th, 2017.

7.      Copy of this order be sent to the District Forum.
