ORDER

CC No.337 of 2022.

Ashu        Vs.       UHBVNL.

 

Present:       Sh. KC Saini, Adv. for the complainant.

                    Sh. Jatinder Bhagat, Adv. for the opponent.

                                               

                Settlement report dated 19.10.2023 from the Coordinator, Mediation Cell of this Commission received. The parties have arrived at settlement, which has been reduced into writing and signed by the counsel for the complainant as well as counsel for the opponents. Ex.S1 is marked on the settlement.  To make the settlement Ex.S1 legally workable, in the para No.4 of the settlement Ex.S1, in forth line word “within the period of one month” inserted. Keeping in view the settlement Ex.S1, the complaint is, partly, accepted with following terms and conditions:-

1. The opponent overhauled the account on the request of the complainant and still Rs.76,000/- (Seventy Six Thousand only) is payable.
2. The complainant agreed to deposit the outstanding amount in the following manner:-

1. Rs.16000/- upto 30.10.2023
2. Rs.30,000/- upto 31.12.2023
3. Rs.30,000/- upto 28.02.2024.

3. The complainant will pay the current bills on the due date regularly.
4. The opponent will issue the no dues certificate within the period of one month, after the receipt of the outstanding amount i.e. Rs.76,000/- which is settled as full and final dues.

 

              It is further made clear, in case, the timely compliance of the order is not done by the opponents and the complainant is constrained to file an execution petition before this Commission to enforce this order, then, the opponents may be liable to make the payment of cost of execution proceeding to the complainant, which shall be assessed by the Commission at an appropriate stage. Due to peculiarity of the facts, parties are left to bear their own cost of litigation. File be consigned to the records.
