Case taken up at 3.45 P.M. But none appeared on behalf of complainant.  Perusal of case file reveals that today the case is fixed for evidence of complainant or settlement, if any, but neither complainant nor  his representative appeared before the Forum.  It is 3.50 P.M.  Further wait is not justified.  On perusal of file, it has come to the notice of the Forum that Ops have refunded the amount of Rs.15,000/- charged as penalty alongwith surcharge  amounting to Rs.914/- for the period w.e.f. January 2015 to May 2015 totaling a sum of Rs.15914/- vide sundry items No.1 dated 03.06.2015 which has been placed on record by counsel for the Ops alongwith their reply i.e Memo No.1555 dated 03.06.2015 as Annexure R-1 and copy of sundry as Annexure R-2. Perhaps the relief sought by the complainant has been released by the Ops to the complainant and thus he has chosen not to appear before the Forum.  In these circumstances, we have no option except to dismiss in default the present complaint for non-appearance of the complainant.  Copies be supplied to parties concerned, as per rules. File after due compliance be consigned to record room.
