ORDER

 

1.                     Complainant Harcharan Singh  has filed the present complaint under section 12 of the Consumer Protection Act 1986 praying therein that respondents (hereinafter referred as OPs) be directed not to interfere, put hindrance, in the normal, smooth supply of electricity connection of the complainant and to pay Rs. 3000/- as cost of proceedings.  

2.                     Brief facts of the present complaint as alleged by the complainant are that the complainant is having domestic electricity connection bearing account No. YM-30075 and paying all the bills for actual consumption to the Ops. Besides the complainant, there are some other persons who are consumer/user of the electricity connection from the same electric line from the last 20 years and now the OPs are planning and threatening to up-root the said electric line of the complainant and others to shift their respective connections to some other electric line at a far off distance from the house of the complainant, which is wrong and illegal. The complainant alongwith other persons requested the OPs not to shift their connections so many times but they refused to listen the genuine request. Hence this complaint.

 3.                    Upon notice, opposite parties appeared through counsel and filed written statement by taking some preliminary objections such as complaint is not maintainable, no cause of action, no locus standi and on merit it has been stated that it is wrong to allege that OPs have planned to uproot the alleged electricity line or to shift the same to other place. Neither there is any plan for the same nor the OPs tried to shift the said electricity line and lastly prayed that complaint of the complainant is totally false and manipulated which is liable to be dismissed with costs.

4.                     Both the parties failed to produce any evidence and ultimately evidence of both the parties was closed by court order vide order dated 21.9.2015.  

5.                     However, at the time of filing of complaint copy of electricity bills Annexure A-1 to A6 and copy of ration card Annexure A7 to A-15 were filed.   

6.                     We have heard the learned counsel for OPs and have gone through the pleadings as well as documents placed on file very minutely and carefully. However, none appeared on behalf of complainant.

7.                     The only plea of the complainant is that the OPs are going to shift the electricity line to some other electric line at a far off distance from the house of complainant whereas as per version of the OPs mentioned in written statement in para No.5 on merit the OPs are not going to shift the electric connection of the complainant to other place and neither shifted nor trying to shifting the connection of the complainant from one place to another place. Moreover, the complainant failed to file any evidence in support of his version. Hence, in view of the written statement filed by the OPs we have no option except to dismiss the complaint of the complainant as there is no deficiency in service on the part of OPs and the complaint of the complainant has been filed merely on the apprehension.

                        Resultantly, we find no merit in the present complaint and the same is hereby dismissed with no order as to costs. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
