O R D E R

The following order of the Commission was delivered by Shantanu S. Kemkar, J  :

                        Feeling aggrieved by the action of the respondent – Bank in refusing to honour the cheques issued by the appellant – complainant thereby committing deficiency in service by the respondent, the appellant had filed a complaint case No.173/2014 under Section 12 of the Consumer Protection Act, 1986 (for short ‘Act of 1986’) before the District Consumer Disputes Redressal Forum, Ujjain (for short ‘Forum’).

 

2.                     The Forum vide impugned order dated 17.2.2016 while allowing the complaint has ordered the respondent to pay Rs.20,000/- with interest @ 7% p.a. to the appellant for deficiency in service committed by them. 

 

3.                     Dissatisfied with the awarded amount, the appellant – complainant has filed this appeal seeking enhancement of compensation amount.

 

4.                     We have heard learned counsel for the parties and perused the record.

 

5.                     On perusal of the record it is revealed that on account of not entering the issuance of cheque book to the appellant in its record few cheques issued from the said cheque book were not honoured by the Bank.

6.                     Having considered the nature of deficiency and other relevant evidence the Forum has awarded compensation of Rs.20000/- with interest @7% per annum to the appellant.

 

7.                     In our considered view the compensation amount as has been awarded is just and proper and as such needs no enhancement.

 

8.                     In the result, the appeal fails and is hereby dismissed.  No order as to costs.
