Complainant files hazira. Op files hazira.

 

Today is fixed for filing evidence on affidavit by the complainant.

At this stage Ld. Advocate for the complainant submits that the matter has been settled by and between the parties outside the court. Op also accepted that the matter will be settled. Ld. Advocate for the complainant prays for a cost.

 

Op files a petition stating that the op bank files petition today stating that the op bank returning today the duplicate copy of 06 (six) KVPs. as mentioned in the schedule of the complaint vide nos. 90 CD 209467 TO 90CD 209472 all dated 14/03/2013 to the complainant through this commission.

 

Op also states that there is no latches or negligence on the part of this op for returning those KVP after a long time.  Ld. Lawyer submits verbally why they are unable to pay those documents to the complainant.

 

Op also prays for accepting those duplicate six (06) KVPS and handover the custodian of those upon the complainant.

Complainant received those copy of six (06) KVP and prays that the complainant had been suffered for a long time so a cost may be imposed upon the op as compensation.

 

Heard the Ld. Lawyer for the both parties and perused the records and documents filed. After hearing this commission   is in the opinion that as the complainant has been suffered for a long time so compensation be given to the complainant. Hence it is ordered the case be and the same is finally disposed of subject to payment of cost of Rs.7000/- payable to the complainant as compensation.

 

A free copy of order be supplied to the parties with free of cost.
