                   Sh. Manhar S.Saini, Advocate has put in appearance on behalf of the respondent/Opposite Party by filing his vakalatnama, which is taken on record.

                   We have perused the record of the Forum and heard appellant in person as well as Counsel for the respondent/Opposite Party.

                   Perusal of the record shows that the complaint was dismissed at the preliminary stage on 04.06.2019 in CC/561/2019 by District Forum-I, UT, Chandigarh. Now Counsel for the respondent/Opposite Party has appeared. This Commission is of the view that at least one opportunity be given to the respondent/Opposite Party to file reply and evidence/affidavit and for this purpose, the case be remitted to the concerned Forum.

                   In this view of the matter, this Commission is of the view that there are adequate grounds and reasons to set aside the impugned order. Therefore, the appeal stands disposed of and the impugned order is set aside and the matter is remitted to District Forum-I, UT, Chandigarh with a direction to dispose of the matter preferably within a period of three weeks from the date of receipt of reply and evidence/affidavit from the respondent/Opposite Party.

                   Counsel for the respondent/Opposite Party is directed to file reply and evidence/affidavit on the next date fixed before the Forum.

                   Anything expressed above shall have bearing on the merits of the case.

                   Parties/their Counsel are directed to appear before the concerned Forum on 22.11.2019.

                   Certified copies of this order be sent to the parties, free of charge.

                   Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.

                   File be consigned to the Record Room after completion.
