          The electric meter installed at the premises of the petitioner was checked by the vigilance staff and the seal was found to be broken.  The meter was sent to the M&T laboratory for checking.  The laboratory found the seal to be duplicate.  Based on the report submitted by the laboratory, the respondent imposed a penalty of Rs.49,919/-.  Aggrieved by imposition of the penalty, petitioner filed a complaint before the District Forum.

          District Forum, vide its order dated 19.11.2004, allowed the complaint, aggrieved against which the complainant/respondent filed an appeal before the State Commission.  State Commission, by a majority of 2:1, allowed the appeal holding that it was a clear case of theft of energy.

          We agree with the majority view taken by the State Commission that the petitioner was guilty of stealing the electricity.  Dismissed.
