          The Counsel for the appellant Sri Akhilesh Trivedi submits that though the appeal has been filed on 28-03-2023 and was listed at least on eight dates and got adjourned on different reasons, however, during the pendency of the instant appeal the matter has been settled between the appellant and the opposite party, the bank.

          In view of the above statement the instant appeal is dismissed as withdrawn.
