CONSUMER COMPLAINT NO. 309  OF  2022

ORDER

1.        Vide his separate statement already recorded on 10.10.2023, Sh.Nitin Gupta, Partner of OP No.2 has stated that the matter has been settled between the parties and as per settlement, the OP No.2 shall pay a lumpsum amount of Rs.47,000/- to the complainant and the complainant will return the TVS Jupiter ZX Scooter in question, alongwith its two original keys & accessories, to OP No.2. It has been further stated by him that out of total settled amount of Rs.47,000/-, an amount of Rs.30,000/- has been paid in cash to the complainant today(10.10.2023) and the remaining amount of Rs.17,000/- will be paid to the complainant on receipt of the following documents from the complainant, which shall be provided by the complainant within 3 weeks from today(10.10.2023):-

1. Registration Certificate of TVS Jupiter ZX Scooter in question.
2. Insurance Certificate of TVS Jupiter ZX Scooter in question.
3. Valid No Objection Certificate from the Bank regarding clearance of loan of TVS Jupiter ZX Scooter in question.
4. Cleared Challan Receipts of TVS Jupiter ZX Scooter in question.

          Sh.Nitin Gupta, Partner of OP No.2 has further stated that he has received the TVS Jupiter ZX Scooter in question from the complainant today(10.10.2023).

2.        Vide his separate statement, Sh.Souravh Sharma, Complainant has admitted the aforesaid statement of Sh.Nitin Gupta, Partner of OP No.2. Complainant has stated that he has received Rs.30,000/- in cash from Sh.Nitin Gupta, Partner of OP No.2 and TVS Jupiter ZX Scooter in question has been handed over to him and it has been prayed that the complaint be disposed of in terms of aforesaid settlement. It has been further stated by complainant that he withdraw his complaint against OP No.1 and the present consumer complaint be dismissed as withdrawn against OP No.1.

3.        Today, vide his separate statement, Sh.Pragun Jasuja, Advocate Proxy for Sh.Sandeep Jasuja, Advocate for OP No.2 has stated that Sh.Nitin Gupta, Partner of OP No.2 has received one broken key of TVS Jupiter ZX Scooter in question alongwith accessories from the complainant and both the parties will be bound by the statements made on 10.10.2023 and prayed that the complaint be disposed of accordingly. Vide his separate statement, Sh.Varun Veer Chauhan, Advocate for Complainant has admitted the aforesaid statement of Sh.Pragun Jasuja, Advocate Proxy for Sh.Sandeep Jasuja, Advocate for OP No.2.

4.        In view of the statements and in terms of the settlement, the complaint stands disposed of by passing the following order:-

1. OP No.2 shall pay remaining amount of Rs.17,000/- to the complainant on receipt of the following documents from the complainant;-

1.   Registration Certificate of TVS Jupiter ZX Scooter in question.

2.   Insurance Certificate of TVS Jupiter ZX Scooter      in question.

3.   Valid No Objection Certificate from the Bank    regarding clearance of loan of TVS Jupiter ZX   Scooter in question.

4.   Cleared Challan Receipts of TVS Jupiter ZX Scooter in question.

              The aforesaid documents shall be provided by              the complainant within 3 weeks from 10.10.2023.

2. The present consumer complaint stands dismissed as withdrawn against OP No.1.

5.        Certified copies of this order be sent to the parties free of cost. The file be consigned.
