Fixed for argument and exparte against OP 1.

Ld. Advocate for complainant files his hazira.

Ld. Advocate for OP 2 files his hazira.

OP no 1 files a petition to vacate order of exparte hearing along with W.V copy sevied.

Let it be register as Misc Case 35/2017.

Mise case is taken up for hearing Heard perused the petition.

It appears that W.V has been files so we like to give OP 1 and Opportunity of being heard.

So we are incline to allow this Misc case

Hence it is order

that the Misc case no 35/2017 be and same is allowed on contest; but without cost

order of expart hearing is vacate of W.V filed by OP 1 is accepted. 

Thus this Misc case is disposed off fix 11/10/2017 for argument
