Power of attorney on behalf of op filed. Learned counsel for op has suffered a statement that matter has been compromised with the complainant in the National Lok Adalat and as per compromise, op will pay an amount of Rs.20,000/- as full and final settlement to the complainant within 15 days after receiving of bank account number and particulars of complainant and in case of default the ops shall be bound to pay compensation of Rs.10,000/- and Rs.5000/- as litigation expenses and also to pay interest on the settled amount at the rate of @6% per annum and now both the parties have no complaint against each other. Learned counsel for complainant has also suffered a statement that above said statement of learned counsel for op is acceptable to him and op may be bound down by above said statement and he does not want to proceed further with the present complaint and same may be dismissed as withdrawn.
In view of the statements of learned counsel for parties, present complaint is dismissed as withdrawn being compromised in the Lok Adalat. However, op is bound down by the above said statement of its counsel and the op is directed to pay the above said amount of Rs.10,000/- to the complainant within a period of 15 days from the date of receipt of bank account number and its particular of complainant, failing which op shall be liable to pay the above said settled amount of Rs.20,000/- alongwith interest at the rate of @6% per annum from the date of this order till actual payment and also to pay an amount of Rs.10,000/- as compensation and Rs.5000/- as litigation expenses to the complainant. A copy of this order be supplied to the parties well within time free of costs. File be consigned to the record room.
