By filing this Revision, M/s Honda Cars India Ltd., the Revisionist has challenged the Order dated 16-01-2018, passed by the Ld. District Forum, Kolkata-III (South) in CC/636/2017.

In short, case of the Revisionist is that, although it received summon from the Ld. District Forum directing it to appear before the Ld. District Forum on 08-12-2017, copy of the complaint petition was not received by it initially which was made available only on 03-01-2018.  As the WV could not be made ready by 16-01-2018, it’s Ld. Counsel sought for some time to file reply.  However, such prayer was rejected by the Ld. District Forum and it was ordered to proceed ex parte against the Revisionist. Aggrieved with such decision, this Revision is preferred by the Revisionist.

Parties were heard through their respective Ld. Advocates and documents on record gone through.

Considering all aspects, in the interests of natural justice, we deem it fit and proper to allow this Revision with a token cost.

The Revision, accordingly, stands allowed in part.

O R D E R E D

The Revision stands allowed with a cost of Rs. 5,000/- being payable by the Revisionist to the Respondent No. 1.  Parties to appear before the Ld. District Forum on 12-12-2018 for payment of cost and further order.
