ORDER     By Smt. Padmini Sudheesh, President:                     The case of complainant is that on 2.6.09 the complainant along with his three friends visited the restaurant of respondent by name Silver Bowl and taken food. They had taken buffet lunch, one sweet corn chicken and two soft drinks. The respondent issued bill for Rs.359/- including tax and also issued another bill for Rs.575/- as table charge. The respondent has no right to issue bill for Rs.575/- as table charges. This act of respondent is deficiency in service and unfair trade practice. Hence the complaint.           2. The respondent is called absent and set exparte.           3. The complainant is examined as PW1 and Exts. P1 to P3 are marked in support of his claim.           4. Ext. P2 is a bill issued for Rs.575/- towards table charge. According to the complainant this is unfair trade practice and respondent has no right to issue such a bill and collect the amount. He has no dispute with regard to Ext. P3. Since there is no evidence to the contrary the complaint is liable to be allowed.              5. In the result the complaint is allowed and the respondent is directed to return Rs.575/- (Rupees five hundred and seventy five only) with interest at the rate of 12% per annum from the date of Ext. P2 till realization with cost Rs.500/- (Rupees five hundred only) within one month from the date of receipt of copy of this order.                               Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum this the 17th day of September 2011.
