JUSTICE SHRI. K.R. UDAYABHANU: PRESIDENT
The application is filed to condone the delay of 404 days on the ground that the complainant was suffering from intravertebral disc prolapse and was under treatment from 1/4/2005. A medical certificate in support of the case has also been produced. The complaint was dismissed for default. The matter relates to the electricity bill amounting to Rs.1,21,222/-.
The opposite parties have opposed the application.
It is stated in the medical certificate that the complainant during the treatment had a fall and the same aggravated slip disc. The opposite parties have filed objection which is formal in nature. As such we find no reason to disbelieve the case of the complainant. It is also submitted that the complainant has closed his business but he has been foisted with the above electricity bill. In the circumstances the delay is condoned. Dismissing the complaint for default is also set aside. The matter is remitted back to the Forum. The Forum will dispose of the matter on merits. Appeal stands posted before the Forum on 10/5/2011.
