Complainant absent. No representation. Opposite parties 2 and 4 represented. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued. The opposite parties 2 and 3 appeared. Opposite party 1 was no more. Opposite party 2 and 3 is declared as exparte due to the filing of version. Additional opposite party 4 impleaded as the legal heir of the opposite party 1. Complaint filed IA.242/2022 to direct the opposite party 4 to furnish the details of the legal heir of the opposite party 1. Details of the legal heir of the opposite party 1 is furnished by the opposite party 4 on 24/08/2022. Since 31/08/2022 the case is posted for taken steps by the complaint against the legal heir of the first opposite party and for the evidence of the complainant. When the case came up for consideration today It is noticed that the complaint was continuously absent since 13/07/2022 and not taken any steps to impleaded the legal heir of the opposite party 1 and to adduce the evidence in support of this case. Notice was duly served to the complaint on 07/12/2022 as per track record. Inspite of receipt of notice and availing ampile opportunity the complaint is not taken any steps against legal heir of the opposite party 1 or adduce the evidence. In the above circumstances we find that the complainant is not interested to further proceed with this complaint. In view of above discussion that we are of the opinion that this is fit case to the dismissed for default. In the result the complaint is dismissed.
